Standards Of Review Chart. Appellate courts accord the greatest deference to a jury's factual findings. A low standard of review means that the decision under review will be varied or overturned if the reviewing court considers there is any error at all in the lower court's decision.
There are essentially four standards of review: abuse of discretion (probably the most common), review, de novo the "any evidence" test, and the clearly erroneous standard. If paper records, are all documents properly secured to chart? The applicable standard of review thus is crucial to any appeal.
The Kansas Supreme Court Rules highlight the standard of review's importance by requiring both parties to include it in their briefs.
